Terms of Use

These terms govern the use of the curling tournament management platform available at curlingpoint.ca (the "Platform"), operated by Sébastien Audet, doing business as AudeTI Solutions ("we"). By creating an account or using the Platform, you accept these terms.

1. Accounts

1.1 An account belongs to an individual. You are responsible for keeping your password confidential and for the actions taken with your account.

1.2 You must be 18 or older to create an account.

1.3 You agree to provide accurate information and to keep it up to date.

2. Plans and tokens

2.1 Free plan. A Free tournament is limited to 16 teams and 2 categories, displays advertising and does not refresh automatically on screen. Each Free tournament is independent.

2.2 Tokens. Premium features are activated with tokens. The number of tokens consumed depends on the number of teams in the tournament, according to the schedule published on the Platform at the time of activation.

2.3 Definition of a tournament. A tournament is an event held at a single venue on consecutive dates. Separate dates or venues constitute separate tournaments, even if they share a name or a cumulative ranking.

2.4 Payment. Tokens and plans are paid by Interac e-Transfer, following the instructions provided. They are credited to your account upon receipt of payment.

2.5 Validity. Tokens do not expire as long as your account exists.

2.6 Refunds. An unused token is refundable on request, at the price paid. A token debited for an activated tournament is not refundable. If a tournament is cancelled before its first game, the token is credited back to your account.

2.7 Unlimited plan. The Unlimited plan covers one curling season (September to the end of April). It ends on the April 30 following its purchase and is renewed by a new payment.

2.8 Prices. We may change the price schedule. A change does not affect tokens already purchased.

3. Your data

3.1 Your tournament data (teams, schedules, results, logos, sponsors) belongs to you. You grant us only the right to host, process and display it in order to provide the service.

3.2 You may export your tournaments at any time (JSON or CSV), whatever your plan.

3.3 Publication. A tournament's public pages can be viewed by anyone, without an account.

3.4 Content you provide. You warrant that you have the right to use the logos, images and sponsor names you upload.

3.5 Retention. Tournaments remain online as long as the organizer's account exists. When the account is closed, its tournaments and their public pages are deleted.

4. Acceptable use

It is prohibited to:

• publish content that is illegal, hateful, defamatory or that infringes the rights of others;
• attempt to access other people's accounts or tournaments;
• disrupt the service (overloading, bots, circumventing plan limits);
• resell access to the Platform without our written consent.

We may suspend an account or remove content that breaks these rules.

5. Availability and liability

5.1 We make reasonable efforts to keep the Platform available, particularly during tournaments, without guaranteeing uninterrupted operation.

5.2 Support. All plans include email support, with no guaranteed response time. For a Premium or Unlimited tournament, the organizer also has a direct line (mobile, call or text) during the tournament's playing hours, with a response within 2 hours or less. Response means we begin handling the request; the time to resolution depends on the issue.

5.3 Results and standings are calculated from the data entered by organizers and scorers. The organizer remains responsible for their accuracy and for the official decisions of the tournament.

5.4 To the extent permitted by law, our total liability is limited to the amount paid for the tournament concerned during the previous 12 months.

5.5 Nothing in these terms limits the rights granted to you by the Quebec Consumer Protection Act, if it applies to you.

6. Termination

You may close your account at any time by writing to us. Unused tokens are then refunded under section 2.6. Export your tournaments before closing.

7. Changes

We may change these terms. The version in force and its date are published on this page. A significant change is announced by email or at login at least 30 days before it takes effect.

These terms are governed by the laws applicable in Quebec.
